This Agreement contains the terms of use of the www.areo-fire.com (the “Website”) and the online purchase policies on the Website between you, including the persons and companies you represent, and Aréo-Feu Ltée. (“Aréo-Feu”). 

Please read these online terms of sale carefully: they contain important information about your rights and obligations and the limitations and exclusions that may apply to you. 

By placing an order, you signify that you have read and understood this agreement and accept the implications of its terms and policies legally binding on you under applicable laws and regulations.

Secure Online Shopping
When you shop on the Website, we want it to be with peace of mind. That is why we do business with Clover/Bambora to ensure the security of your personal and banking data and to protect the transactions you make online through the Website. Limitation of liability

Please note that the information presented on the Website is that which Areo-Fire had at the time of the development of the content of the Website.  It is, therefore, possible that this information, or part of it, is no longer up to date at the time of your consultation of the Website.  Despite all the care provided by Areo-Fire, errors may have occurred.  The Website and the information contained therein are not subject to any warranty, express or implied.  

Links to other websites that may appear on the Website are provided for informational purposes only. Aréo-feu can in no way be held responsible for the information contained therein or the consequences that may result from the consultation and use of these links, the websites to which they refer, and the information they contain.  

Areo-Fire is not responsible for the use that may be made of the personal information that you communicate to third parties through the Website, including Clover/Bambora. To this end, Areo-Fire encourages you to consult the privacy policies put in place by these third parties, if any.

    

Password and security
You have complete responsibility for all activities on your customer account and/or with your password.  Consequently, if you use a password to access this site and/or any part of it, you are responsible for maintaining the confidentiality of that password.  If you use a customer account, you are responsible for controlling and limiting its access.  If the confidentiality of your password and/or access to your customer account is compromised, you must notify Areo-Fire immediately. Areo-Fire reserves the right to take any action it deems necessary or reasonable to ensure the security of this site or your customer account, including term noting your account, changing your password, or requiring you to provide certain personal information to authorize transactions on your account. Despite the preceding, Areo-Fire will presume the legitimacy of any access to and/or use of your customer account and/or password and will in no way be held responsible for any action taken without your consent and/or any unauthorized use of your customer account or password, including, in particular, any unauthorized transaction or purchase made online through the Website or otherwise using your customer account or password.

Content of
The Website and all its content are the exclusive property of Areo-Fire. They are protected by all applicable laws and regulations, including in particular Canadian and international laws on copyright and trademarks. You are prohibited from modifying, copying, distributing, displaying, publishing, selling, or otherwise disposing of all or part of the Website and its content for any purpose whatsoever.  
 
Areo-Fire reserves the right to update and/or modify the data of the Website, the products and services available online, prices and fees, and the various promotions at any time and without warning. Areo-Fire cannot be held responsible for the consequences resulting from such updates and/or modifications to the website’s content, in particular the consequences that such updates and/or modifications may have on the relationship between you and a third party.

Applicable Laws and Jurisdiction
You agree and acknowledge that the Website, its use, and any dispute that may result is governed exclusively by the laws of the Province of Quebec and the federal laws applicable therein. In the event of any dispute relating to the use of the Website or any transaction made through it, you consent to the jurisdiction and venue of the courts of Quebec and agree to submit any such dispute and assign exclusive jurisdiction to the Courts of Quebec, more specifically to the appropriate Court of the District of Montreal.

Payment
The total cost of your purchase will be indicated on your order confirmation. Payment must be made by credit card (Visa, Mastercard, and American Express) or by entering the purchase amount into your customer account if you have such an account.

Prices
Prices are subject to change without notice. The prices shown on our site do not include shipping and handling charges and applicable taxes that will be added during billing, depending on the billing address. All prices and other amounts appearing on the Website are in Canadian dollars.

Availability
Although most of the items advertised on the Website are in stock and ready for delivery, Areo-Fire cannot guarantee the availability of all items at the time of your order or in the future. If an item is out of stock, an employee will try to contact you to inform you of the situation and take possible steps to try to accommodate you. The terms of delivery of your order will be discussed at this time, including if more than one item in your order is out of stock or otherwise unavailable.

Areo-Fire reserves the right to set a maximum and/or minimum quantity of products and services that you may obtain through the Website or otherwise.

Returns
Please review the terms and conditions of our Return and Exchange Policy to determine if your item can be returned or exchanged, as some items cannot be returned or exchanged.

Validity and confirmation of your order
Any order will be considered valid only when Areo-Fire approves it by sending you an email confirming the approval of your order.

Modification or cancellation of your order
Orders are processed immediately by Areo-Fire. For this reason, if you need to change or cancel your order, you must do so within twenty-four (24) hours of the time you placed your order by contacting customer service. After this period, Areo-Fire cannot guarantee that your order can be modified or cancelled and additional fees may apply. Under no circumstances may you modify or cancel your order by email. Areo-Fire reserves the right to refuse, modify, delete or cancel an order at any time and without notice, whether already accepted or not, for any reason that Areo-Fire deems valid.

If you have any questions about your order, please contact our customer service. We do not accept email requests for order changes or cancellations.

Special Orders
Special orders on quotation, items related to health, or in case of sale of products whose manufacture is undertaken on special order of the buyer are not refundable or exchangeable.

Payment methods
If you pay by credit card, an amount equal to the transaction amount will be blocked in your account when ordering. This amount will be charged to your account at the time of delivery. No copy of your invoice will be sent to you, but you will be able to print and keep a copy of your invoice when your online transaction on the Website is completed.  Areo-Fire encourages you to keep a copy of your invoice, especially since this invoice will be necessary if you need to return or exchange goods.

If you place a purchase with your customer account, an invoice will be sent to the billing address at the time of delivery. You will then have to pay this invoice according to the terms and conditions.

Credit Card
All credit cards must be valid and genuine, and you must be authorized to use them.  If the charge you attempt to make to a credit card is not authorized or accepted, Areo-Fire reserves the right to cancel your order without notice and any liability or obligation on its part to you or a third party. Areo-Fire reserves the right to stop accepting credit cards from one or more issuers, holders, or users at any time and for any reason. Areo-Fire assumes no responsibility to anyone for the illegal or unauthorized use of one or more credit cards during a transaction on the Website or otherwise.

Customer account
To take advantage of customer account benefits, employees authorized to purchase on behalf of their organization must have a password given by Areo-Fire. If you have not obtained your password, contact our customer service at [email protected].

If you already have a customer account with Areo-Fire, you will need to activate it during your first online transaction through the Website by logging in and filling in the required fields, your username, and password (previously provided by Areo-Fire). For your order to be charged to your customer account and for billing to be made accordingly, you will need to enter your purchase order number, previously granted by your Fire Department or company, when you place your order on the Website. Otherwise, you will be able to pay by credit card.

Ownership of the goods
Despite the invoicing of the goods by Areo-Fire and the withholding of an amount on your credit card by Areo-Fire, the latter will retain full ownership of the goods ordered, through the Website or otherwise, even if these goods have been delivered to you, and you have accepted them, wherever they are located, until full payment of this merchandise.

Shipping Methods
Areo-Fire offers only one shipping method for the goods ordered: Purolator. Delivery times can vary between 2 to 10 working days. Areo-Fire does not guarantee these delivery times and cannot be held responsible for additional delivery times, particularly in the event of a strike, bankruptcy, slowdown of operations, etc., of the sender. Deliveries are made from Monday to Friday. The delivery address may differ from the billing address.

Delivery Costs
Delivery costs are calculated according to the distance and weight of the package. Delivery to certain provinces and territories involves additional shipping costs, which will be indicated to you when you confirm your order online on the Website.

All costs incurred due to a change of delivery address or reshipment once the ordered goods have left our warehouse will be charged to you.

Restrictions
The goods for sale on the Website are only available in Canada. Some goods cannot be delivered to all provinces and territories. Areo-Fire reserves the right to unilaterally modify without warning the countries, provinces, or territories for which its goods are available for online purchases on the Website.

In-store Pickup
You can place your order online and then pick it up directly in-store by choosing this option when you place your order online on the Website. Areo-Fire will contact you when the order is completed so that you can pick it up at the customer service counter. To pick up your order, Areo-Fire requires that you present the following documents: the order confirmation email you received from Areo-Fire and a photo ID issued by the provincial or federal government. You have 90 days following the notice given by Areo-Fire that the order is available for pick-up to retrieve your order, failing which Areo-Fire will dispose of your order at its discretion and charge you the resulting costs.

Receipt of the goods
You must examine the ordered goods upon receipt. If an item is damaged or missing, you must contact customer service as soon as possible within ten (10) days of receipt to benefit from the Areo-Fire Return and Exchange Policy, if applicable.
